The Fourteenth Amendment of the Unitized States Constitution in Section 1, Clause 1 states: All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside.

The children born of illegal immigrants on U.S. soil are not United States citizens. If both their parents are citizens of Mexico, they fall under that country’s jurisdiction. Being “within” a country’s jurisdiction and “subject” to a country’s jurisdiction are two completely different things. For example, a crime was committed in the State of Texas. That crime is subject to Texas jurisdiction. If the crime committed were a federal crime, then the FBI would get involved meaning the crime is subject to Federal jurisdiction. There is no case law for the Fourteenth Amendment, but I can straight up tell you that this is indeed what it means. In order for the child to be considered a citizen of the United States, at least one of the parents must be a U.S. citizen.

I honorable served in the Air Force for 5 and ½ years. When I enlisted into the military, I was somewhat interested in going into Intel due to being a natural when it comes to strategizing. I ended up being in the Finance career field. The federal government is the one that trained me on reading and understanding regulations, bills, and the U.S. Constitution, as well as the importance for separation of powers and fiscal law. I’m highly experienced in fraud prevention and know exactly how to handle the immigration issue in the United States. 26 States will be receiving detailed information on a step by step process on how to implement a solution in under 8 years using little to no federal resources. They’ll be able to find and track all illegal immigrants, even the children born of two illegal immigrant parents. Per the United State Constitution, the Federal government may be the only one that can enforce immigration law, but specific enforcement(s) by States has nothing to do with immigration, period.

My advice to all illegal immigrants is that you should self-deport yourself out of the U.S. while you have the chance.

“The protest was in response to the U.S. Supreme Court's deadlock over President Barack Obama's executive actions that would grant relief from deportation and permission to work to immigrants who meet certain requirements. Millions of immigrants and family members across the country had looked forward to a day when they didn't have to fear being picked up by local police or ICE and torn from their families. The court's stalemate was a devastating blow to their dreams.”

There are two parts to the President’s executive order, and both are illegal. The President’s executive order Deferred Action for Childhood Arrivals (DACA) allows certain undocumented immigrants who entered the country before their 16th birthday and before June 2007 to receive a renewable two-year work permit and exemption from deportation. Later, the President modified this executive order and expanded it to include undocumented immigrants who entered the country before 2010, eliminate the requirement that applicants be younger than 31 years old, and lengthen the renewable deferral period to two years.

The first illegal part of the executive order is that the President, Executive Branch, can only execute law. This executive order issued by the President effectively writes law i.e. legislate law. Per separations of power ordained by the U.S. Constitution, only the Legislative Branch may legislate. In case you didn’t know, the Legislative Branch is Congress. The President knows this simply fact, and is trying to circumvent Separations of Power by invoking a clause in immigration law that Congress wrote. This clause he thinks gives him the authority to do this is that he is permitted to “maximize federal resources as efficiently as possible”. Because of this, the Department of Homeland Security (DHS) has sent a memorandum to Immigration and Customs Enforcement (ICE) to only detain illegal immigrants with felonies. The memorandum specifies per the President’s directive to maximize federal resources by following the enforcement priorities he has outlined, which are apprehending illegal immigrants with specific criminal records such as felons etc..

The President cannot simply state that there are inadequate federal funds available to enforce immigration law that has been mandated by Congress. Before he can get around to invoking the immigration clause allowing him to “maximize federal resources as efficiently as possible”, he has to prove current federal resources are inadequate. If he does this and can prove to Congress that the resources they’ve budgeted toward U.S. immigration are inadequate, then Congress will decide whether or not to issue emergency funds. If Congress chooses to note increase federal funds towards U.S. immigration, then the President can go about invoking the immigration clause.

What the President has done is equivalent to a U.S. military base blowing its entire budget on things it may not necessarily need, and then going to Congress for emergency funds to keep the base operational. If a base commander did this, then Congress is going to want all federal tax dollars accounted for and an explanation why federal resources were not properly utilized and/or budgeted for that year. You would see a bunch of military officers in prison for violating fiscal law by blowing taxpayer dollars. How do we know that the resources being utilized by the Executive Branch aren’t being spent by ICE to purchase buses that cost $10 million apiece to deport illegal immigrants? Exactly, we don’t.

The 287(g) program actually gives the President additional resources he needs to enforce U.S. immigration law. Most States and counties within those States want illegal immigrant out of the United States. Instead of using the 287(g) program to cut costs on a limited budget and exhausting all avenues, the President has invoked a clause allowing him to “maximize federal resources as efficiently as possible”. Violating fiscal law is an impeachable offense and a federal crime for all involved.

“During the same week as the Supreme Court's announcement, Gwinnett officials renewed the county's 287(g) program. No public discussion was allowed prior to the vote. The program has contributed to immigrants residing in Gwinnett's reduced trust in local law enforcement. That's led to less safe communities for everyone. Antonio Molina, who testified against the program's renewal after the contract was approved, told elected officials that 287(g) sends a "mixed message. National and local authorities such as those in Gwinnett should also end programs such as 287(g), which frighten immigrant communities and jeopardize public safety.”

Do you have any clue as to what the 287(g) program is about? The 287(g) program allows ICE to essentially deputize cops with immigration powers. Under an agreed upon memorandum with ICE, the police department selects cops to participate in the program. They are able to apprehend illegal immigrants following enforcement priorities just like as if they were ICE agents themselves. They’re basically like ICE in training, which they are given a superior at ICE that they answer to for all immigration related issues within their jurisdiction. The cops that are trained can have apprehended illegal immigrants transported to a detention facility operated by ICE, which ICE reimburses them for some things such as transportation costs. However, if the trained cops apprehend or transport an illegal immigrant within permission by ICE, at ICE’s discretion it can revoke their deputized immigration power status and may not reimburse them for the transportation costs. Go the ICE gov website and read the 287(g) Memorandum of Agreement Template.

Again I see the straw-man argument of the Europeans "stole" this land. You cannot look at one historical period through the lens of another period's ethics and morals. In many cases those people paid for the land and paid well. Most of those lands had also changed hands between various peoples in their own wars or no one claimed the land at all. And while it had bee several thousand years the "natives" themselves migrated to the Americas from Asia.

I have to agree with Kevin Caron. I would like to assert that I understand our current immigration laws, but they are so convoluted and illogical I question whether anyone can really, fully understand them. Some examples:

A person's status or ability to become a citizen may be affected by what year that person was born;
A limited number of slots for immigration are assigned nations - both Ireland and Australia are allowed more slots than our neighbors Canada and Mexico;
Many of our policies were ghost written by the for-profit prison industry that benefits from full detention centers;
It truly can take 20 years or more to gain citizenship.

Personally, I think our immigration laws serve only those people who smuggle people or employ undocumented aliens - especially people who employ undocumented aliens in near slavery conditions. If we had carefully negotiated open borders with Canada and Mexico so that people could travel, live, and work freely in these three countries, we could then enforce our labor laws more effectively. Enforcement would be encouraged by the fact that laborers hailing from outside the U.S., when told in a post-hiring orientation, that their new job in the peach canning plant pays $2.00 per hour, well, those laborers could report that violation. Properly negotiated open borders would better protect ordinary people in all three countries. But as it stands, there is money to be had (or at least saved) by: 1) using a person's undocumented status to cheat that person out of a fair or legal wage using threat of deportation and possible imprisonment to keep them from protesting and 2) using the threat of employing illegal labor to undermine the legal citizen's standing for a fair wage.

White, European-Americans never had any "legal claim" to the land on which we now reside. There is no denying that this land was stolen from it's native inhabitants. Many of us had ancestors who came to the US fleeing war and poverty to pursue a better life and future for their children and other generations to come - that's us. So, how then, can we call others looking for the same opportunities as our ancestors "illegal"? Do you defend the rich, power-hungry, white men who massacred native americans and built this country on the backs of slave labour? (and the labour of exploited, poor whites for that matter) Is this the foundation on which you lay claim to this land? We are better than this.

The brutality of the US deportation machine is very real. Thousands of children are being sent to foster care in the US, never to see their mothers and fathers again because they were deported! Youth on their way to school are being targeted in ICE raids! Refugees are being deported back to countries where they they may be killed or persecuted!

There is enough for all of us. The immigrant community is not responsible for the poverty and massive levels of inequality that we face in this country and globally - it is the ruling class.

When the wealthiest 1% in this country own more than the bottom 90% of the population combined, the vast majority suffer. And yet, we've allowed the rich and powerful to scapegoat immigrants - immigrants who want the same as us - to be safe, to be free, and to build a better world for their children.

Thank you Ms. Shahshahani for your work in defending and lifting up the voices of immigrants who continue to struggle just to assert their own humanity!

What what about the FBI Director's address did you not understand? How do you feel about a US President who could not get a security clearance today and who was wilfully negligent in her former office?
My brother in law is a yellow dog Democrat and he now says he cannot vote for Clinton, based on this one issue.
