OyDave: The City is only liable if they cite a property owner (hence acknowledging that a risk exists), which is one of the reasons they have not enforced the law to date. Once they cite a property owner, the City needs to be prepared to pay for the repairs in case the owner ignores the citation, otherwise the City is at risk of being sued if someone gets hurt.

MPL: It is this kind of comment that makes me wonder about our educational system: "we will continue to put the onus on the individual when, in an ideal world, I think we would all agree this should be the responsibility of the government".

According to a post over on Reddit, Seattle, LA, and New York all have this requirement so it isn't really that unusual. Still don't see why those who have kept up their sidewalks by paying for repairs should be punished by also paying for the upkeep of the sidewalks of those who can't be bothered with the civic duty the rest of us do without any fuss.

And I agree with Zed.

Thanks Richie Rich. That's awesome that you have $3500 to throw away on property that doesn't actually belong to you, but this law is absolutely ridiculous - not to mention that the selective nature in which it is being enforced is criminal.

This whole debate seems unnecessary. Here are the options: current law, which says that property owners are responsible for the maintenance of the sidewalks abutting their property, in which case those owners need to pay for needed repairs out of their own pockets; or, the City increases property taxes on those same property owners so that the city can fix the sidewalks, the cost of which comes out of those same pockets, except with an additional 20% cost for collecting, managing, and spending those funds.

Personally, I prefer option one.

The side walk is part of the pubic right-of-way, just as the road is. You morons who think that certain private citizens have an extra obligation beyond their normal tax bill to pay to maintain City of Atlanta public right-of-way are sheep who get the government you deserve.

I like what Sally Flocks of PEDS says in the article about sidewalks:

-----
The city streets are maintained by the municipal government, so the sidewalks should be, too, she said.

"The property owners are not responsible to pay for potholes," said Flocks, who also is a member of the task force Smith and Archibong formed. "For pedestrians, the sidewalks are the road, they are their network."
-----

I think this makes sense.

There are crappy sidewalks everywhere in this city.
Should the rest of the city expect to see this enforcement?
