Matthew Cardinale, editor of Atlanta Progressive News, took issue with a blog post I wrote that criticized articles on his website concerning candidates in the mayor's race. I admit I was somewhat harsh, but I feel my points were valid. Still, in the spirit of journalistic goodwill, we're giving Cardinale the opportunity to respond. (For the record, we've trimmed his letter for the sake of space and relevance and I added my own annotations.) Enjoy:
In a post entitled, "Where Mary, indeed?," writer Scott Henry makes a number of false, unsubstantiated, defamatory, unprofessional and vicious statements regarding me and my publication, the Atlanta Progressive News.
The relevant text is as follows:
The latest negative tidbit to surface is a weird piece of innuendo proffered by the Atlanta Progressive News, which is something of a far-left blog masquerading as a media outlet. Acting as an apparent proxy for the Norwood campaign, APN has cluttered e-mail inboxes with a piece insinuating that (Kasim) Reed, in his capacity as an attorney, once battled the NAACP on behalf of Cracker Barrel restaurants. The article, like much of APNs output including several attack pieces previously written about Lisa Borders falls so far short of basic journalistic standards that it scarcely bears notice. Still, another local blogger who also works as an attorney was so offended by the lousy legal analysis she found in the APN piece that she felt compelled to post a point-by-point rebuttal.
Let me go through and respond to his statements individually.
1. First of all, APN's article was not innuendo, it was factual. If anything, it's Henry's post (and previous posts he's written on other topics) that are characterized by innuendo. It is a fact that Reed, in his capacity as an attorney, once battled the NAACP on behalf of Cracker Barrel restaurants.
According to the federal database, PACER, Reed absolutely was an attorney, did represent Cracker Barrel, and on the other side was the NAACP, which both filed amicus briefs on behalf of a class of workers and helped organize this and a series of legal cases pursued against Cracker Barrel at the same time.
Now, some could argue that Cracker Barrel is entitled to a legal defense, or that Reed was just doing his job, etc., but that does not change the fact that he "in his capacity as an attorney, once battled the NAACP on behalf of Cracker Barrel." Henry's failure to back up his statement also means that his comment is the one that is innuendo, but it is also false.
[From Scott: I described the article as innuendo because, in referencing a 1999 case in which Reed was one of many attorneys working on behalf of Cracker Barrel, Cardinale points out that the restaurant chain historically would neither serve Black customers nor employ homosexuals. But the case in question had nothing to do with alleged civil rights violations; it was a workers comp case dealing with employee overtime.]
2. Atlanta Progressive News is a media outlet; it is an online news service and not a blog. First of all, Henry made no statements to substantiate his assertion that APN is a blog masquerading as a media outlet. Therefore, again, he is the one guilty of innuendo.
I founded APN in 2005, back when the only other online news service was Insider Advantage. Today APN is joined in Atlanta by new online news services like Project Q Atlanta and Jim Walls's Atlanta Unfiltered.
In just under four years, APN has produced 549 original, full-length news articles, ranging from a few hundred words to 3,000 words. They are all full of facts, not opinion, aside from a few clearly labeled as analysis or endorsements. All our articles go through an editing process as well, and I, as News Editor and Publisher, take full accountability for every factual statement that appears on our webpages.
I do know he called us "far-left," which frankly I see as a compliment. However, I think if we did a rigorous content analysis of Henry's blog posts we'd learn that he has a position too, "moderate or even waxing right-wing." A content analysis of his writings about the Metro Atlanta Task Force for the Homeless will show his position is one of salivating to close the shelter down.
Henry is constantly mixing facts and opinions in the same articles as that appears to be part of Creative Loafing's editorial style. There's nothing inherently wrong with this, but it means his description of APN as a masquerade is really a projection of his own opinions towards himself.
And as I have said before, there is no such thing as objectivity: even trying to be balanced involves a journalistic construction based on value judgments of what are the sides to be balanced. Creative Loafing is an alternative newsweekly: that implies a perspective. Atlanta has Black papers, Hispanic papers, GLBT publications, etc. Even the Atlanta Journal-Constitution has a perspective as the newsletter of big business and developers.
[Me again: The lawmakers down at the Capitol will be shocked to learn that Im "moderate or even waxing right-wing."]
3. Henry has a history of employing innuendo in his blog posts. For example, on Oct. 22, 2009, he wrote a post without ANY evidence insinuating that former State Rep. Able Mable Thomas was being paid for her endorsement of Mary Norwood. There was absolutely no basis to making this claim at the time, yet Creative Loafing allowed it.
He may argue that weeks later it turned out Thomas was being paid $1,500 for get-out-the-vote work. However, at the time of his first post, there was no evidence, just defamation. In addition, there is no proof there was any connection between the expense reimbursement and the endorsement.
In fact, the endorsement happened first, according to Norwood, and the GOTV work was arranged later through the campaign manager second. Moreover, Henry did not take the time to apply the same question to Lisa Borders (who was paying State Rep. Stacey Abrams tens of thousands of dollars) nor to Kasim Reed (who was paying State Rep. Rashad Taylor thousands and thousands again through his consulting firm).
There is nothing other than Henry's personal biases towards Norwood that would lead him to suspect impropriety in one case, without any evidence, but not in another.
[From Scott: Heres a point that warrants some attention. The Norwood camp has maintained that its paying Thomas is no different than Reed paying Taylor or Borders paying Abrams. This is false.
Taylor and Abrams were hired quite openly as salaried campaign workers. There was never a question about why they supported their candidates because everyone knew they were working for them.
Thomas, on the other hand, was the centerpiece of a splashy endorsement photo op with Norwood. Only later did documents emerge that showed she was on the campaign payroll. I maintain that its misleading to present Thomas endorsement as coming from a disinterested supporter.
And, yes, I most certainly speculated at the time that Thomas was secretly receiving compensation from Norwood, based largely on following Able Mables political career for the past 20 years.
We now have evidence I was right. As they say, the proofs in the pudding.]
4. In closing, I would just like to say that Atlanta Progressive News is my pride and joy, and the result of years of hard work put in by me and several volunteers. We stepped up to provide Atlanta's working families with news they could not get anywhere else. That's what makes Henry's post which comes across as elitist and bourgeois so unfair to us.
In these times of Creative Loafing emerging from bankruptcy, Southern Voice ceasing to exist, and the AJC now a shadow of its former self, Atlanta's remaining media outlets should be lifting each other up, not tearing each other down. So, marinate on that.
Thank you very much for your time,

Actually, if the NAACP only filed an amicus brief in the case Reed worked on. Thus, it is absolutely not factual to say that Reed "battled" the NAACP. While an amicus brief may (and usually does) end up endorsing one side's position, at least on one distinct point, the party filing the amicus is not on one side or the other.
The inclusion of Jim Walls is kinda funny. Wonder what Jim thinks about that. By the way, Matthew. If you don't respond to my email, I'm moving with what I've got. With he requisite "was contacted but at the time of publication had not responded".
who did you vote for president Scott? Bob Barr waxes his mustash, you must have leaned his way.
@lazermike Thanks for noticing. This is why I felt comfortable calling APN out for offering insinuation rather than facts.
Excuse me, Atlanta Progressive News is not a far-left blog masquerading as a media outlet. APN is the only news outlet with the guts to tell the truth about many stories. Such as the plight of the homeless in Atlanta, Bush's illegal war in Iraq and expose all the facts about politicians. Yes, APN reports from the left perspective and thank God for that because 90% of all other reporting is from the right center to the far right.
Monsignor Cardinale had better hope his candidate does not win. There's nothing progressive about Mary: leading Atlanta further up the creek will do nobody of any class any favors. It seems to be mostly about the homeless for Matthew. Mary won't commit to getting tough on cleaning up downtown whereas Kasim promises at least to enforce the panhandling ordinance. As Kasim says, it's not progressive to continue to hurt the hospitality industry and so depress the number of low-skilled jobs available in town.
This sort of disparaging of one paper by another is discouraging and degrading. The Atlanta Progressive News has its followers who are interested in local affairs and who want to read about them from the progressive perspective. There is nothing unprofessional in their articles, there is no other paper reporting the news from this point of view. They have supported Mary Norwood because she is not part of the current group of cronies running Atlanta and she is concerned about the state of the homeless in Atlanta. No other candidate is. Kasim Reed came from the last administration. If you like it you like him. If you don't like it you don't like him. It is that simple. There is no reason to attack Atlanta Progressive News as unprofessional or as a blog. There is no reason to state they do not present both sides of every issue. The job they do is quite appropriate. Creative Loafing has less of a special niche. People use them to find happenings and occasionally read the articles, they are a print paper and more costly. Both have their target audience. For shame that Mr. Thomas should choose to call APN out in public. If they were to close Atlanta would be much poorer for it. Atlanta is the poorer for the new format of Creative Loafing. Mr. Thomas should have kept him comments to a personal correspondence.
One teensy clarification...the case in which Reed represented Cracker Barrel was not a worker's comp. case. It was a Fair Labor Standards Act wage and hour violations case. (Worker's comp. claims are adjudicated in a separate court system.)
"Henry is constantly mixing facts and opinions in the same articles as that appears to be part of Creative Loafings editorial style." No defense from Scott on this one, I see. I think this combination of fact/opinion in what are ostensibly supposed to be "news" articles is one of CL's major faults. I don't mind opinion, but please keep it separate from what should be an accurate news story. If CL's new management reads this, please consider drawing some clear lines between news and opinion.
Jim Galloway rips Cardinale a new one in today's pol insider. If the only dirt Mary's team has on Kasim is his very minor role as a lawyer on a very minor Cracker Barrel case, Kasim is cleaner than I thought. http://blogs.ajc.com/political-insider-jim-galloway/2009/11/19/your-morning-jolt-cracker-barrel-and-the-atlanta-race-for-mayor/ Matthew is an out and out (pun intended) propagandist with no regard for balance, when his dander's up. The attack on Kasim over this case is dirty and wrong-headed to the point of desperation. Will we find that the Cardinale, like Able Mable, is on Mary's payroll? Or is this just one of those occasions when Cardinale loses all judgment and goes apeshit, like he does over his transgender nonsense at GSU, with no cash changing hands? Strange bedfellows for Buckhead Betty, though I guess they both model themselves on pantomime dames.
The Atlanta blogosphere has clearly fallen head over heels in love with the sound of their own banging away at the keyboard. Not that touchscreen monitors and some Windows 7 are gonna make a piece of difference...
Heh. Good point Spacey. This would never have happened if CL still had a REAL editor in charge. On the other hand, it's merely a sight of times where reputable newspapers have turned into blogs.
I was delighted the AJC print edition cited APN in their article on Reed and Cracker Barrel today. Galloway verified and confirmed again that our main points are factual, not innuendo. To be sure, I disagree with his apparent willingness to accept Reed's excuse that it was just his job and that he had to do it or else be fired. As the previous commenter mentioned, I personally have lost a previous job (at GSU) when I stood up for my principles and refused to change my syllabus. But you see, some of us are just more principled than others. And as I've said on other blogs, I think we're responsible for what we do in our jobs.
Scott Henry hit the nail on the head when he described Atlanta Progressive "News" (APN) as little more than a far-left blog masquerading as a reputable, media outlet. APN is nothing but a few people parading around with the self-proclaimed titles of "reporter", "news editor" and "publisher". And I say it is about time Scott Henry and others ended the charade, and called a spade a spade.
Matthew, do you know the difference between your "article" and Galloways? He gave Reed an opportunity to respond. Mighty principled of you.
APN is out with a D6 piece, including useful quotes from Wan, Coyle and Brodie. Of special interest, our Liz seems to have been for the 10th & Monroe condo plan before she voted against it, and she is for it again immediately after voting against it. If people get wise to this, she'll have the flip-flopper vote sewn up. "Coyle said she opposes the rezoning, but that it only affects land currently not used for anything which sits behind the dog grooming shop next to Park Tavern. She added that she believes the community will eventually support the proposed condo--which is not covered by the R-4 rezoning--but that it may be fewer than eight stories in the end." http://atlantaprogressivenews.com/news/0550.html
Mary takes her Buick down the low road in mailers delivered to us today. They attack Kasim for alleged late payment of taxes, the story they started with APN. Never mind that Jim Galloway in Political Insider showed the story is a web of inaccuracies and exaggerations. I guess the campaign is desperate and Mary, a pretty nice person, has lost control of her henchfolks. It has not been enough to avoid a debate with the clearly competent and intelligent Kasim, which would show their candidate for the ninny she is. Throwing mud is all they have left. Let's hope he responds with more dignity.
