California's Prop. 8 ruled unconstitutional

Posted by Gwynedd Stuart on Wed, Aug 4, 2010 at 5:22 PM

Logic wins!

It was announced just minutes ago that a California judge ruled that Proposition 8, which defined marriage in that state as being between one man and one woman, violates the the U.S. Constitution.

Gawker.com posted an excerpt from the ruling:

Proposition 8 fails to advance any rational basis in singling out gay men and lesbians for denial of a marriage license. Indeed the evidence shows Proposition 8 does nothing more than enshrine in the California constitution the notion that opposite sex couples are superior to same sex couples.

According to GA Voice, a rally is scheduled to take place this evening at 6:30 p.m. at the corner of Piedmont and 10th in Midtown.

Before you party too heartily, keep in mind the decision will most definitely be appealed. Next stop: the U.S. Supreme Court.

I thought that the people who live in California voted for Prop 8. Sounds like Pete Stark is right when he says that the Government can do anything it wants to do.

From a 1934 cartoon:
“SPEND! SPEND! SPEND – Under the guise of recovery – bust the government – blame the capitalists for the failure – junk the Constitution and declare a dictatorship”

It's a telling cartoon from 1934! Pretty amazing I think.

Yeah, Pete, let's just let the people vote on my life.

Pete, don't many conservatives want to bust the government (i.e., "starve the beast")? Are you cleverly implying that conservatives are seeking a dictatorship?

Pete, do you not buy in to one of the founding principles of this country that majority rule is not a right to subject a minority to unfair treatment or persecution?

The whole basis of the courts is that they are supposed to be insulated from politics and thus serve as check or balance when majority rule does crap like prop 8. That is why Handel's crap trying to demonize with politics the court system bothers me so much.

I mean what happened to the pursuit of happiness so long as it does not infringe on others. How does gay marriage infringe on others? Talk about a nanny state or Governement telling people how to live their life.

Thanks for the extremely helpful and relevant cartoon! Though I don't think it teaches the lesson you think it does.

Pete, you make as much sense as your fellow Teabaggers who insist that Gubmint is to keeps its grubby paws off of your Medicare.

I take it that you're against government in your life, but *for* government in Everyone Else's lives.
