The the Arizona-esque immigration law that basically allows the police to racially profile immigrants — illegal or otherwise — but that stipulates that they can't actually racially profile immigrants because that would be unconstitutional was upheld by a three-judge panel in Atlanta yesterday. The decision said: “Reliance on race, color, or national origin that is constitutionally prohibited, however, is expressly forbidden by the Georgia statute. It is inappropriate for us to assume that the state will disregard its own law, and we therefore reject the argument in this respect, keeping in mind that unconstitutional application of the statute could be challenged in later litigation.” Stay tuned for later litigation.
